Subject: The Improvement of Procedure and Management Mechanism of the Temporary Import of Empty Container via the International Customs Border Checkpoint of Friendship Bridge I.
- Pursuant to Customs Law no. 04/NA, dated 20 December 2011 and Customs Law (Amended some articles) no. 57/NA, dated 24 December 2014;
- Pursuant to the Prime Minister’s Order no. 02/PM, dated 01 February 2018 on the Improvement of Regulation and Coordination Mechanism for Doing Business in Lao PDR;
- Pursuant to the Minute of Consultation Meeting between Customs Department and Private Sector, dated 30 April 2018;
- Pursuant to the Field Work Minute of Technical Task Force of the Customs Department at the International Customs Border Checkpoint of Friendship Bridget 1 on 15-16 May 2018 no. 00722/CD.FB1, dated 21 May 2018.
In the past, there were some operators who requested to the Customs Department on the management of temporary import of empty container for containing goods in the country and then transport and reexport via the International Customs Border Checkpoint of Friendship Bridget 1 which created delays and difficulties, had several procedures and affected the export of the operators.
In order to address the above issues in timely manner, the Customs Department transfers the responsibilities to the Customs Regional Office V to lead the International Customs Border Checkpoint of Friendship Bridget 1 to carry out as follow:
- The International Customs Border Checkpoint of Friendship Bridget 1 is assigned to take lead on the improvement of procedure and management of the temporary import of empty container in simplified and speedy manner, and in consistent with Customs Law.
- The temporary import of empty container of each company shall comply with Article 27 of Customs Law no. 04/NA, dated 20 December 2011 that the company shall request to the International Customs Border Checkpoint of Friendship Bridget 1 for consideration and approval to allow the temporary import by authorizing the Head of Unit to manage and sign the IM7 form to allow the temporary import of empty container as specified regulation. The International Customs Border Checkpoint of Friendship Bridget 1 is not allowed strictly to require the importing company to draft the letter every time or shipment which creates delay and difficulty.
- The International Customs Border Checkpoint of Friendship Bridget 1 shall monitor and inspect the unit who takes responsibility to issue the IM7 form. If there are several volume of container imports, the unit shall use the additional allowance book of IM7 for each company and place the responsible officer in sufficient with the practical activity.
- To pay attention to disseminate the regulation and procedure on the import and export management of container to the operator for acknowledgement and understanding, along with facilitating the import and export. Any violation, shall carry out the measure as specified in the Customs Law strictly.
- Any difficulty of the implementation, shall report the Customs Department for guidance and solution.
