Notification
To: Customs Inspection Units I-VII and Border Customs Checkpoint Across the Country
Subject: The Implementation on Export Procedure of Minerals, Non-Timber Goods and other Goods.
- Pursuant to Law on Customs no. 04/NA, dated 20 December 2011 and Law on Customs (Amended Some Articles) no. 57/NA, dated 24 December 2014;
- Pursuant to Decree of Prime Minister no. 08/PM, dated 02 July 2018 on the Enhancement of Minerals Activities Management in Lao PDR;
- Pursuant to Order of Prime Minister no. 02/PM, dated 01 February 2018 on Improvement of Regulations and Coordination Mechanism for Doing Business in Lao PDR;
- Pursuant to Instruction of Customs Department no. 01624/CD, dated 04 March 2019 on Decree of Prime Minister no. 48/GOV, dated 19 February 2019.
In the past, the Customs Department issued the Notification no. 01616/CD, dated 04 April 2018 on the Minerals Export Management to ensure the implementation on export management of minerals, non-timber goods and other goods in facilitated, simplified, accurate, flexible and harmonized manner across the country.
Customs Department notifies:
- The collection of export tariff shall comply with the Presidential Edict no. 02/PSD, dated 27 April 2012 on List of Goods and Export Tariffs;
- For the goods and belongings which have paid the special charges (Export tariffs) according to article 15 and 16 of National Assembly Resolution no. 47/RMC, dated 26 June 1989, shall not pay the special charges (Export tariffs);
- Exporting minerals, non-timber goods and other goods which have paid the natural resource charges and have the export license from relevant sectors shall proceed documentation for detailed customs declaration in the exporting customs checkpoint which is not necessary to obtain the permit from Customs Department again in compliance with the customs declaration procedure according to the Instruction of Customs Department on Detailed Customs Declaration via Electronic System no. 0097/CD, dated 06 January 2017;
- Customs Inspection Units are assigned to lead and guide the Border Customs Checkpoints under their own managements on the export inspection tightly in aspect of type, quantity, value and weight as well as to facilitate and use the inspection tools such as X-Rays, weight scales and other tools. In addition, to summarize and conclude the export statistics every three months to Customs Department (Customs Formalities Division) for monitoring and inspection;
- Customs Inspection Units and Border Customs Checkpoints across the country are assigned to implement this Notification together and strictly;
- If it is found the difficulty on implementation, shall conclude and report to Customs Department for solution according to the laws and regulations;
- This Notification shall become effective and replace the Notification of Customs Department no. 01616/CD, dated 04 April 2018.
Therefore, this is notified for acknowledgement and implementation together.
