To: Director Generals of Provincial and Vientiane Capital Department of Industry and Commerce.
Subject: The Extension of the Prime Minister’s Order No. 15/PM, dated 13 May 2016 on Enhancing Strictness on the Management and Inspection of Timber Exploitation, Timber Movement and Timber Business.
- Pursuant to Decree No. 522/PM, dated 23 December 2011 on the Organization and Operation of Ministry of Industry and Commerce;
- Pursuant to the Order No. 15/PM, dated 13 May 2016 on Enhancing Strictness on the Management and Inspection of Timber Exploitation, Timber Movement and Timber Business; and
- Pursuant to the Notification No. 769/PSPM, dated 1 June 2016 on the Extension and the Implementation of the Order No. 15/PM, dated 13 May 2016.
In order to enhance responsibilities and ensure unambiguous implementation of the Prime Minister’s Order No. 15/PM, dated 13 May 2016 and the Notification No. 769/PSPM dated 1 June 2016 effectively and efficiently.
Minister of Industry and Commerce issues an Order to Provincial and Vientiane Capital Department of Industry and Commerce, District’s Office of Industry and Commerce as below:
1. Immediately disseminate, raise awareness of the Order No. 15/PM, dated 13 May 2016, the Notification No. 769/PSPM dated 1 June 2016, and this Order to agencies, officers and private sector to comprehend, become deeply aware of and uniformly implement them effectively.
2. Enhance and pay attention on carrying out obligations and duties based on roles and responsibilities assigned as per the relevant laws and regulations on the management of timber movement and timber business.
3. Facilitate and cooperate with relevant authorities and pay attention to follow, inspect the implementation of the Order No. 15/PM dated 13 May 2016, the Notification No. 769/PSPM dated 1 June 2016, and this Order according to your roles effectively. If any violation is found, the authority shall take action strictly according to laws and regulations.
4. The Provincials and Vientiane Capital Department of Industry and Commerce, District’s Office of Industry and Commerce shall terminate the issue of export license for all type of timber and forestry products, including transit license through Lao PDR in all cases.
5. Provincials and Vientiane Capital Department of Industry and Commerce shall coordinate with District’s Office of Industry and Commerce to immediately enhance the minute of an adjustment wood processing factories signed between the Ministry and some provinces and carry out the adjustment of wood processing factories nationwide. During this time, the departments shall focus on dealing with factories located near national preserved forest; national protected forest and produced forest. If a violation or illegal industry establishment is found, the authority shall coordinate with relevant agencies to stop, terminate and seize timbers as state’s property and strictly proceed according to laws.
6. As for the timber auction, the Provincials and Vientiane Capital Department of Industry and Commerce shall take a leading role to coordinate with relevant agencies to widely organize the auctions and give priority to the wood processing factories who are members of the Nation Timber Processing Association and National Furniture Association.
7. Provincials and Vientiane Capital Department of Industry and Commerce shall report outcome of the extension and implementation of the Order No. 15/PM dated 13 May 2016, the Notification No. 769/PSPM dated 1 June 2016, and this Order to the Ministry of Industry and Commerce to endorse and give directions timely.
8. This Order becomes effective on the date of its signature. The previous orders, decisions, notifications, and legal document in contravention of this Order are held null and void.
