Decree
On the approval of the controlled business list and concession activity of Lao PDR
- Pursuant to the law on the government of Lao PDR (amended version) No. 04/NA, dated 08 November 2016
- Pursuant on the law of investment promotion No. 14/NA, dated 17th November 2016
- Pursuant to the proposal letter from the ministry of planning and investment No. 2994/PMI.I4, dated 29th November 2018.
Prime Minister issue a decree on:
Article 1: Adopted list of controlled and concession of Lao PDR as attached in annex “A” of this decree.
Article 2: Controlled list is the controlled business that has impact on national security, social peace and glorious national tradition and environment, society and nature and to ensure the socio - economic development to steadily expand. Any investment in the controlled list must be considered and provided with feedback from relevant agencies after the committee for promotion and management of investment in central or local level.
Concession list is the business list where investors receive approval for investment such as land concession, the development of special economic and processing manufacture zones with the purpose to export, mines exploration, the development of energy sources, airlines concession and telecommunication.
Article 3: Government is promoting investment in all sectors, business set forth and excluded in the controlled list and concession business of Lao PDR though out the country, except for business that will be violating national stability and security, having negative impact on environment now and in the future, on people’s lives and national glorious tradition as well as prohibited list of business.
Procedures for submitting approval request to invest under the controlled business: submit the request letter to the one stop service unit at central or local level according to the management designation as set forth in annex “A’’ of this decree. The one stop service unit must collaborate with concerned agencies at central or local level to revise and pass the proposal letter to the committee for promotion and management of investment to seek for their approval according to their designated responsibility within 25 working days counting from the day the one stop service unit has received a complete the proposal letter. After receiving the approval for investment, enterprises or legal entity can operate their investment according to laws. In case of particular investment regulated by specific law and regulation and required for special permit before operation. Those enterprises have to comply with the pertaining regulation.
For private enterprises or domestic and foreign legal entities that old enterprise registration license according to law on enterprise of Lao PDR and would like to request for investment permit or run a new business or add a new business in the controlled list shall directly submit their request letter to one stop service unit as stipulated above.
For concession investment projects: domestic and foreign legal entities with intention to invest in concession project in Laos shall submit the request letter to one stop service at central or local level to review and propose to the committee for promotion and management of investment according to their designated responsibilities (as attached in annex “A’’ of this decree) and to consider within 65 working days counting from when the one stop service unit has received a complete set of request letter.
Article 4: Concerned agencies are designated to clearly and concisely amend or create legal documents pertaining the requirement of document and approval consideration within their agencies before submission to the one stop service unit to inform investors.
Article 5: concerned agencies could propose to amend, add or reduce the list of business types that agencies are in charge of in the controlled and concession list where necessary in accordance with periodical policy of concerned agencies through the committee for promotion and management of investment at central level to consider proposing to the government to adopt.
Article 6: Ministry of planning and investment is assigned to implement, disseminate, instruct, monitor, inspect, and promote the implementation of this decree for its best result.
Article 7: Ministries, organization equivalent to ministries and local administration at all level are to strictly implement this decree.
Article 8: This decree becomes effective from the day of signature; other decrees, decision and regulations before and against this decree are terminated.
