Decision
on continuing to assign the Customs at the Border Checkpoints for verifying preferential tariff rates of the ATIGA-FORM D of 11 import companies
- Pursuant to the Customs Law No. 81/NA, dated 20 June 2020;
- Pursuant to the Prime Minister's Order No. 12 / PM, dated 16 October 2019 on the facilitate the import-export, temporary import, transit, and movement of goods in Lao PDR;
- Pursuant to the agreement of Lao PDR in the ASEAN Commodity Trade Agreement or ATIGA signed on 26 February 2009;
- According to the report of the Division of Legislation No. /DL, dated 29 July 2021.
The Department of Customs’ Decisions:
Article 01. Agree to assign the customs at the border checkpoints across the country can certify the preferential tariff under the scope of the ASEAN Trade in Goods Agreement (ATIGA) or Form D. The documents of customs declaration as defined in Article 27 (amendment) of the Law of Customs No.81/NA, dated 29 June 2020. For these 11 companies which do not need to apply the certificate of preferential tariff at the Department of Customs in order to pilot to determine the conditions of AEO standard. The list of companies are as details below:
1. Souvanny Home Center Public Company;
2. Beer Lao Company Limited;
3. New Jib Chen Company Limited;
4. Coca-Cola (Lao) Bottling Company Limited;
5. Lao Ford City Company Limited;
6. Express Food Group (Laos) Company Limited;
7. Lao Mobile Group Company Limited;
8. Unilever Service (Laos) Co., Ltd;
9. TIPCO Asphalt Lao Company Limited;
10. Toyota Laos Co., Ltd. and
11. CI Import-Export Trading Co., Ltd.
Article 02: Assign the international border checkpoint for importation to inspect and consider the preferential goods under the ATIGA or Form D for all types of goods, excluding vehicles-machines, all kinds of fuel, alcoholic beverages and tobacco.
Legislation - References and procedures for checking the Certificate of Origin Form D shall be in accordance with the Instruction of the Department of Customs, No. 03782/DC, dated 06 February 2016 on the Certificate of Origin and the preferential tariffs as the terms of Free Trade Agreement which Lao PDR is a party.
Article 03: This consideration of gaining preferential tariffs under the ATIGA framework or Form D is a temporarily pilot project for only companies which are approved. Once this pilot project is completed, the authorized officers of the import border checkpoints shall summarize and report the implementation to the Customs Department (Legal Division) for evaluating the outcome in terms of improving a better step.
Article 04: Assign to the relevant departments of the Department of Customs such as the Customs Administration Division and Customs checkpoint to collaborate in order to implement this decision to be completed as planned. If the actual practice faces the difficulties, authorized person shall be coordinate and report to the Department of Customs for addressing in accordance with the laws and regulations.
Article 05: This decision shall come into force within 06 (six) months from the date of signing.
