Decision
to authorize the Division of Industry and Commerce of Provinces and the Capital in issuing and managing the Certificate of Origin under the Preferential
- According to the Decree on the organization and operations of the Ministry of Industry and Commerce, No. 604/PM, dated 15 October 2021;
- According to the Decree on the Origin of Import and Export Goods, No. 228/PM, dated 22 April 2010;
- According to the Department of Import and Export’s Letter, No. 2638/DIMEX, dated 30 August 2022.
The Minister of Industry and Commerce has issued a decision:
Article 1 Authorizes the right to the Division of Industry and Commerce of Province, the Capital to issue and manage certificates of origin under the preferential as follows:
- Form A is issued for general goods that meet requirements of the rules of origin under the preferential;
- Form D is issued for goods that meet requirements of the rules of origin under the ASEAN Trade Agreement;
- Form S is issued for goods that meet requirements of the rules of origin under the trade agreement between the Government of the Lao PDR and Vietnam;
- Form DFTP is issued to goods that meet conditions of the rules of origin under the non-reciprocal preferences from India;
- Form APTA is issued for products that meet the conditions of the rules of origin under the Asia-Pacific Free Trade Agreement;
- Form AI is issued for products that meet conditions the rules of origin under the ASEAN-India Free Trade Agreement;
- Form AHK is issued for products that meet conditions of the rules of origin under the ASEAN-Hong Kong, China Free Trade Agreement;
- Form RCEP is issued to products that meet conditions of the rules of origin under the Regional Comprehensive Economic Cooperation Agreement.
Article 2 In considering to issuance of the certificate of origin under the preferential shall follow the terms, conditions, and instructions of the certification of the origin under the preferential as defined in each contract from time to time.
Article 3 The Department of Import and Export to coordinate and guide the Division of Industry and Commerce of Provinces, the Capital to implement this decision to be highly effective.
Article 4 This decision is effective from the date of signing
This decision has replaced the decision on authorized the right of the Division of Industry and Commerce, throughout the country, to issue certificates of origin under the preferential, No. 2036/MOIC.DIMEX, dated 12 October 2010, and the decision authorized the right of the Vientiane Capital Division of Industry and Commerce to issue and manage certificates of origin under the preferential, No. 1880/MOIC.DIMEX, dated 05 September 2012.
