Recently, the Kingdom of Thailand had issued the Second Export and Import of Goods Act of the Kingdom of Thailand 2015 as an additional act after the Export and Import of Goods Act 1979.  It has been enforced on 14th December 2015 which defines the definition of “transit” that will enhance the transit or reload of goods in Thailand to third country in orderly and explicitly manner. At present, the Thailand’s Embassy in Lao PDR declares the progress on the announcement of the Second Export and Import of Goods Act of the Kingdom of Thailand 2015 that the Department of Foreign Trade, Thailand’s Ministry of Commerce will issue notifications to control and manage the transit of goods particularly prohibited goods or controlled goods according to notifications of Thailand’s Ministry of Commerce due to they are sensitive goods that may affect Thailand’s economic or stability which is now under the cabinet’s consideration as follows:

1.       Draft of announcement to specify goods with measures for import or export as prohibited goods to transit through Thailand, including 8 items: counterfeit products/trademark violated product, copyright violated product, game machine, narghile, ancient object, Buddha image and graven image, elephant and caffeine.

2.       Draft of announcement to specify boycotted goods by the General Council of the United Nations as prohibited goods for transit from 8 countries to protect stability, morals of citizens, life and human’s health, art and culture, history or value of archaeology or trading asset or national industry.

Other products, for instant, wooden and finished wooden, cassava and other 22 agriculture products that is compulsory to open for market according to WTO liability, along with palm oil, corn for animal, onion, garlic, milk and sugar are goods excluded from prohibited goods and shall be valid to export, is currently under the consideration of the responsible committee to define suitable measures to each product for example: requiring Certificate of Origin, Certificate of Phytosanitary or indicate checkpoints for import-export due to they are sensitive products which may effects farmers or Thailand’ economic in which the Ministry will subsequently issue announcements.

Through coordination and meeting between Department of Import and Export, Ministry of Industry and Commerce of Lao PDR with Department of Foreign Trade, Ministry of Commerce of Kingdom of Thailand noticed that currently goods with measure for import-export according to Thailand’s Ministry of Commerce could be proceeded under the control of Thailand’s Department of Customs which importer-exporter are require to conform Announcement of the Department of Customs No .210/2558 on customs procedures for transit and Announcement of the Department of Customs No. 211/2558 on customs procedures for reload. When the drafts of announcements are approved and enters into force, importer-exporter will require to conform them.
