To:      -    President of Petroleum Association and Gas of Lao PDR

  • Director of Companies who deal with Petroleum Business

Subject: The implementation of Decree on Petroleum Business.

 

  • Pursuant to the Decree on Petroleum Business no. 331/PM, dated 27 October 2017.
  • Pursuant to the Organization and Implementation of Permanent Secretariat Office of Ministry of Industry and Commerce No.1237/MOIC, dated 25 July 2016.

 

Currently, the Decree on Petroleum Business no. 331/PM, dated 27 Oct 2017 has been promulgated. The contents of the Decree’s identify clearly on the companies of Import and Export Petroleum, domestic distributors, refuelers, and petroleum service companies. Therefore, in order to ensure the implementation of the Petroleum Business as uniformity through the country, ensuring the benefits of the state, entrepreneurs and consumers

Permanent Secretariat Office, Ministry of Industry and Commerce issued Notification and implementation as following:

  1. The companies has been established and operated in according to the Decree No1785.MOIC.DTD, dated 7 September 2009, must be inform a clear position: to be continues operation as import and export, domestic distributors, renting warehouse provider, supplier of petroleum refineries or joint venture company and request to change Business License to the registration Authorities of the Ministry of Industry and Commerce as described in Enterprise Law No 46.NA, dated 26 December 2013, Investment Promotion Law No 14/NA, dated 17 November 2016 and Decree on Petroleum Business no. 331/PM, dated 27 October 2017
  2.  During the transition period in the first 6 months of the year 2018, the certification of the fuel distribution plan is following the condition of provision of Decree No 1785/MOIC.DTD, dated 7 September 2009. The certification of the fuel distribution plan for 6 month in the end of the year 2018 is only considered the companies comply with the Decree on Petroleum Business no. 331/PM, dated 27 October 2017.
  3. Individuals, legal entities aiming to set up the company on petroleum business operations must following the procedures as described in Enterprise Law No 46.NA, dated 26 December 2013, Investment Promotion Law No 14/NA, dated 17 November 2016 and Decree on Petroleum Business no. 331/PM, dated 27 October 2017
  4. To setup of the new Gas Station must be follow the Notification on the implementation of Decree on Petroleum Business. No. 0529/PSO.DTD, dated 09 March 2018 until replaces by new notification.

 

Hence, this has to inform and strictly on the implementation.
