Notification

On the last updated Certificate of Origin under the ASEAN Trade in Good Agreement

 

To: -  The office of the authority certifying the country of origin (CO) of the product with Trade Preferential;

  • Exporters who use the Certificate of Origin under the ASEAN Trade in Goods Agreement (Form D).

Subject: Implementation of the revised Certificate of Origin under the ASEAN Trade in Goods Agreement.

 

  • Pursuant to the notification of the Prime Minister Office on the First Protocol to amend the ASEAN Trade in Goods Agreement No. 451/PMO, Dated 03 April 2020;
  • Pursuant to the outcome of the 52nd ASEAN Economic Ministers' Meeting and the 34th ASEAN Free Trade Area Council Meeting held on 25 August 2020..

 

The Permanent Secretary Office of Ministry of Industry and Commerce is pleased to inform that from 21 December 2020 onwards, the only revised version (Form D) is introduced under the ASEAN Trade in Goods Agreement (ATIGA), which contains some revisions to the print in the back (attached the current Form D and the updated version) as detailed below:

  • For the revised version Form D, Article 10 has been added with the words “FOB Value: This is applicable for goods exported from and imported by the Kingdom of Cambodia, Republic of Indonesia and Lao People's Democratic Republic and where the Regional Value Content (RVC) criteria is applied, by providing the FOB Value of the goods in Box 9 ” means that for the implementation of export and import of goods to the Kingdom of Cambodia, Republic of Indonesia And the Lao People's Democratic Republic, which applies value-added policies within ASEAN is not less than 40% (RVC 40%) is required to specify the FOB price of the goods in chapter 9 box of Form D.
  • Article 11 of the current Form D has been moved to Article 12 of the revised version Form D, changing the wording from “BACK-TO-BACK CERTIFICATE OF ORIGIN: In case of Back-to-Back CO, in accordance with Rule 11 (Back-to-Back CO) of Annex 8 of the ATIGA, the Back-to-Back CO box should be ticked (√) ”comes as“ BACK-TO-BACK CERTIFICATE OF ORIGIN: In case of Back-to-Back CO, in accordance with Rule 11 (Back-to-Back CO) of Annex 8 of the ATIGA, the Back -to-Back CO box should be ticked (√) and the reference number and the date of issuance of the origin CO (Form D) shall be indicated in Box 7 ” explain that at the time of implementation of continuous export design in accordance with the rules of origin Trade under the ASEAN Trade in Goods Agreement as specified in the regulation 11 in the attachment 8 must have a symbol (√) in the Back-to-Back CO box with the enter the number and date of the original Form D issuance in box 7 of the newly issued Form D.

 

Note: For Form D printing during this period should not be ordered in large quantities to avoid overuse in order to save the budget.
