-          Entrepreneurial Units which use the Form of Rules of Origin

 

Subject: The Utilization of Form for Rules of Origin, Form D and Form AK (Revised Version)

                    -          Based on an agreement made at the meeting of the Sub-Committee on ATIGA Rules of Origin SC-AROO

                    -          Based on an agreement made at the meeting of the ASEAN-Korea Sub-Committee on Tariff Rules of Origin: AKSTROO

The Permanent Secretary Office of the Ministry of Industry and Commerce is honored to notify that from 1 January 2014 onward, it will begin to the use of FORM D (within the framework of the ASEAN Trade Agreement) and FORM AK (within the framework of the ASEAN-Korea Trade Agreement) in the revised version which introduces a change in the content of column 9 of the said form with the following details:

For FORM D: there will a change in column 9 from the existing wording of “Gross weight or other quantity and value (FOB)” to “Gross weight or other quantity and value (FOB) where RVC is applied”

For FORM AK: there will a change in column 9 from the existing wording of “Gross weight or other quantity and value (FOB)” to “Gross weight or other quantity and value (FOB) where RVC criterion is used”.

While all other remaining content remains the same, column 9 of the revised forms requires the specification of FOB price but only for goods that are related to the Regenerated Value Criterion (RVC). Additionally, for the determination of origin of goods using the Common Tariff Certificate (CTC), Special Processing (SP) and Within Country Origin of Products (WO), it is not required that the FOB price in the column should be specified.

The time frame regarding utilization of the revised FORM D and FORM AK is set to be from 1 January 2014 onward. As for the old version of FORM D and FORM AK, they will be permitted and continued to be used in parallel with the new version for the first 6 months until 30 June 2014. After this period starting from 1 July 2014 onward, only the use of the new version of the forms will be permitted.

Therefore, this is to notify and inform you so as to implement accordingly. However, in order to avoid an oversupply of unutilized forms and unnecessary use of budget, during this time there is no need to print out or procure too many copies of the said two forms.
