Prime Minister’s Decision

On the authorization for Provinces, the Capital

To consider and make decisions on exportation of planted timber in the form of logs and sawed timber

-          Pursuant to the Law on Government of Lao PDR no.02/NA, dated 06 May 2003.

-          Pursuant to the Law on Forest no.06/NA, dated 24 December 2007.

-          Pursuant to the proposal from the Ministry of Industry and Commerce no.379/MOIC.DIMEX, dated 04 March 2014.

In order to comply with the government’s policy on planted timber to be a commodity for export and in order to facilitate the business environment by reducing unnecessary procedures for exporting planted timber, in conformity with the three [principles] policy to decentralize rights and responsibility from central.

 

The Prime Minister decides:

 

Article 1:      authorizes provinces, the Capital to consider and make decision on the approval for the exportation of planted timber (Teak, Rubber, Agar wood, Eucalyptus, Acacia auriculiformis and Acacia mangium) in the form of logs and sawed timber.

Article 2:      the Department of Industry and Commerce at provincial level, the capital shall be responsible for considering and making decisions on the approval of the exportation of planted timber in the form of logs and sawed timber according to the species mentioned in Article 1 based on the certificate of origin of timber certified by the Department of Agriculture and Forestry at provincial level and the Capital.

Article 3:      The Department of Agriculture and Forestry at provincial level and the Capital shall responsible for certifying the origin of planted timber and shall responsible for managing, inspecting and monitoring the transportation of planted timber to be exported abroad, in order to avoid the opportunity of smuggling natural timber and other planted timber other then that mentioned in article 1.

Article 4:      The Ministry of Industry and Commerce and the Ministry of Agriculture and Forestry shall issue the implementing guidelines to elaborate the content of this decision for effective implementation.

Article 5:      Ministries, equivalent agencies, the Capital, provinces throughout the country and relevant organizations shall acknowledge, cooperate and strictly implement this decision according to their own function.

Article 6:      This decision shall be effective from the date of signature.
