Notification

To: All governmental agencies, International Organizations, enterprises, individuals, entity persons, and import- export businesses
Subject: The determination of Customs value based on transaction value of general imported goods for home consumption

  • Pursuant to the Customs Law No. 05/NA, dated 25 May 2005;
  • Pursuant to the Prime Minister’s Decree No. 362/PM, dated 19 October 2007 on the implementation of Lao Customs Law;
  • Pursuant to the Finance Minister’s Instruction No. 1398/MOF, dated 16 June 2010 on the determination of Customs value for general imported goods.

In order to manage and implement the determination of Customs value to be consistent with the Customs Law and regulations and procedures of the World Trade Organization.

The Customs Department issues the notification:

  1. Agrees to implement effectively Customs valuation based on the transaction value for general imported goods for home consumption in accordance with the Article 13 of the Customs Law No. 5/NA, dated 25 May 2005.
  2. Agrees to suspend and eliminate the implementation of any legislations and procedures relating to reference prices for general imported goods which issued by Customs Department previously and this notification will replace and determine Customs value based on the transaction value.
  3. Assigns all divisions of the Customs Department, Regional Customs Offices and all international Customs checkpoints to disseminate this notification to related governmental agencies, international organizations, entity persons and the trading community involved in the importation of general goods to know and understand this notification as well as implementing it.
  4. This notification will be effective and shall be implemented from 1 August 2011 throughout the country.

Therefore, this notification is issued and the cooperation from related parties to implement it effectively is requested.
